These Terms and Conditions govern reservations and purchases made through GameDayActionPhotos.com. Game Day Action Photos is operated by Patty Ingalls Photography (“Game Day Action Photos,” “we,” “us,” or “our”).
By submitting a reservation, making a payment or using this website, you agree to these Terms and Conditions.
ADVANCE RESERVATION REQUIRED
Game Day Action Photos provides individual event photography for students whose coverage has been reserved in advance.
A parent, legal guardian or authorized adult must submit the reservation form before the stated deadline. Choosing to pay cash at the event does not eliminate the advance-reservation requirement.
Walk-up requests and payments do not guarantee coverage.
PARENT OR GUARDIAN AUTHORITY
By reserving coverage for a minor, you confirm that you are the student’s parent, legal guardian or an adult authorized to arrange photography coverage and provide the submitted information.
Children under 13 should not submit reservations or personal information directly through this website.
CUSTOMER INFORMATION
You are responsible for providing accurate information that allows the photographer to identify the correct student, including the student’s name, activity, jersey number, position, instrument, uniform details or identification photograph when requested.
Game Day Action Photos is not responsible for missed coverage caused by incorrect, incomplete or outdated identifying information.
Please notify us promptly if any submitted information changes.
COVERAGE AVAILABILITY
Coverage is offered only for events that Game Day Action Photos has chosen to photograph. Availability is limited and may close before the published deadline when all available coverage spots have been reserved.
Submitting a reservation does not grant the customer control over the photographer’s location, access or movement during the event.
SCOPE OF COVERAGE
Game Day Action Photos will make reasonable professional efforts to locate and photograph the reserved student during the selected event.
Coverage does not guarantee:
• A particular play, performance, expression or moment
• A specific number of finished photographs
• Equal coverage during every portion of the event
• Photographs from locations restricted by the school, venue, officials or event organizers
• Photographs of a student who does not participate or cannot be identified
Photography decisions, including positioning, timing, composition, image selection and editing, remain within the photographer’s professional discretion.
PRICING AND PAYMENT
The available payment options are:
• $80 — Reserve in advance and pay cash at the event
• $85 — Reserve and pay online
Online coverage is not considered paid until the payment has been successfully processed.
Customers choosing the cash option must pay at the selected event unless another arrangement has been approved in advance.
Prices and payment options may change for future events. The price shown when the reservation is submitted will apply to that reservation.
EVENT CHANGES, WEATHER AND ACCESS
Sporting events may be delayed, relocated, rescheduled, shortened or canceled because of weather, school decisions, venue conditions, safety concerns or circumstances outside the photographer’s control.
Photography may also be limited by field access, lighting, venue rules, credential restrictions, officials, crowd conditions or safety requirements.
If an event is rescheduled, we may transfer the reservation to the rescheduled event when Patty is available. If Patty cannot cover the rescheduled event, the customer may receive a refund or credit for the amount paid.
CANCELLATIONS AND REFUNDS
If Game Day Action Photos cancels the reserved coverage or is unable to attend the selected event, any amount paid for that coverage will be refunded.
If the event takes place and the reserved student participates but no deliverable photograph of that student is produced, the customer may request a refund of the coverage fee.
Refunds are not automatically provided when:
• The student does not attend or participate
• The student leaves the event early
• Incorrect identifying information was submitted
• The photographer could not identify the student
• The customer changes plans after the reservation deadline
• Coverage was limited by venue restrictions or circumstances outside the photographer’s reasonable control
Refund requests must be submitted promptly after the customer receives notice that the gallery is complete.
IMAGE SELECTION, EDITING AND DELIVERY
Game Day Action Photos determines which images meet its professional and technical standards for delivery. Unedited files, rejected images and RAW camera files are not included.
Finished images will generally be delivered electronically through an online gallery or download link. Delivery timing may vary according to event schedules, image volume and other photography commitments.
Temporary online galleries and download links may expire. Customers are responsible for downloading and safely backing up purchased photographs.
COPYRIGHT AND PERSONAL-USE LICENSE
All photographs remain copyrighted by Patty Ingalls Photography and Game Day Action Photos.
After payment, the customer receives a nonexclusive license to download, print and share the delivered photographs for personal, noncommercial use.
Photographs may not be:
• Sold, licensed or submitted for commercial use
• Used to promote a business or organization without permission
• Entered into contests or publications without permission
• Materially altered, filtered or edited in a way that misrepresents the photographer’s work
• Used to remove or conceal copyright notices or watermarks where present
Schools, teams, media outlets, sponsors and businesses must obtain separate permission for commercial, promotional or publication use.
PROMOTIONAL USE
Purchasing coverage does not automatically grant Game Day Action Photos permission to use a minor’s photographs in advertising.
Any promotional, portfolio or social-media use requiring permission will be governed by a separate authorization, release or consent provided by the parent or legal guardian.
COMMUNICATIONS
By submitting a reservation, you agree that Game Day Action Photos may contact you by telephone, email or text message regarding:
• Your reservation
• Payment status
• Student-identification questions
• Event changes or cancellations
• Gallery and image delivery
• Customer-service matters
Message and data rates may apply. Reply STOP to opt out of text messages or HELP for assistance.
Marketing messages will be sent only when separately authorized. Marketing consent is not required to purchase photography services.
PRIVACY
Personal information is handled according to the Game Day Action Photos Privacy Policy, available at:

LIMITATION OF LIABILITY
To the fullest extent permitted by law, the total liability of Game Day Action Photos and Patty Ingalls Photography arising from a reservation or photography service will not exceed the amount paid for the affected coverage.
We are not responsible for indirect, incidental or consequential losses arising from an event cancellation, missed moment, venue restriction, technical failure or circumstances outside our reasonable control.
Nothing in these Terms excludes any right or remedy that cannot legally be limited.
CHANGES TO THESE TERMS
We may update these Terms and Conditions as our services, pricing or business practices change. The version in effect when a reservation is submitted will govern that reservation.
GOVERNING LAW
These Terms and Conditions are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
